Part 1: Website Terms of Service

1. Acceptance of Terms

By accessing or using the ProPraisal website (propraisal.com) and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

2. Description of Services

ProPraisal provides independent, expert-backed property value reviews for homeowners and other clients. Our services include the ProScan Review (a preliminary value check) and ProConsult Assessment (a comprehensive value analysis with consultation). These services provide opinions of value and are NOT formal appraisals. They are not intended for lending purposes or to meet the requirements of any lending institution or government agency.

3. User Responsibilities

When using our services, you agree to: (a) provide accurate and complete information about yourself and your property; (b) use the services only for their intended purposes; (c) not misrepresent the nature or results of our services to third parties; and (d) comply with all applicable laws and regulations.

4. Payment and Fees

All fees are due at the time of order. Prices are listed on our website and are subject to change. Payment is processed securely through our third-party payment processor (such as PayPal). By submitting payment, you authorize us to charge the applicable fees to your payment method.

5. Refund Policy

If ProPraisal determines that we cannot provide a clear opinion of value for your property due to insufficient data, unique property characteristics, or other limiting factors, you will receive a full refund of the service fee. Refund requests for other reasons will be considered on a case-by-case basis. Please contact hello@propraisal.com within 7 days of receiving your report.

6. Intellectual Property

All content on the ProPraisal website, including text, graphics, logos, and software, is the property of ProPraisal or its content suppliers and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works from this content without express written permission.

7. Disclaimer of Warranties

ProPraisal services are provided "as is" without warranties of any kind, either express or implied. We do not warrant that our services will meet your specific requirements or that the results will be error-free. Our value opinions are based on available data and professional judgment but are not guarantees of actual market value.

8. Limitation of Liability

To the fullest extent permitted by law, ProPraisal's liability for any claim, loss, or damage arising from the use of our website or services is limited to the fee paid for the applicable service. ProPraisal is not responsible for any indirect, incidental, special, consequential, or punitive damages.

9. Indemnification

You agree to indemnify and hold harmless ProPraisal, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of our services or violation of these terms.

10. Governing Law

These Terms of Service are governed by the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of our services shall be resolved in the state or federal courts located in Cook County, Illinois.

11. Changes to Terms

ProPraisal reserves the right to modify these Terms of Service at any time. Changes will be effective upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

Part 2: ProScan Terms & Disclosures

Purpose of the ProScan Review

The purpose of the ProScan Review is to provide a preliminary, independent opinion of a home's market value as of the effective date—typically the date the review is completed. This helps clients quickly determine whether their property's assessed value appears reasonable and whether further action, such as a property tax appeal or more detailed valuation review, may be worthwhile.

Data Sources and Analysis

To prepare your ProScan Review, we rely on multiple trusted sources of real estate information. These include public county and assessor records, local MLS data, third-party real estate databases, and ProPraisal's proprietary sources and market analytics. Our analysis is guided by experienced professionals with extensive residential valuation backgrounds. We analyze recent comparable sales and available property details to develop a preliminary opinion of value. While we take care to use reliable information, we cannot guarantee the accuracy or completeness of public records or third-party data.

Intended Use

The ProScan Review is prepared as a preliminary value check to help homeowners understand whether their property's assessed or estimated value appears reasonable. It may be used to inform decisions about whether to pursue a property tax appeal, seek a more detailed valuation analysis, or simply gain clarity on a home's approximate market value. The ProScan Review is not intended for lending purposes.

Intended User

The intended user of the ProScan Review is the client who orders the service and is identified in the report. No other intended users are identified unless agreed to in writing by ProPraisal in advance.

Third-Party Reliance

No other person or entity may rely on the ProScan Review for any purpose. Receiving a copy of the report does not make anyone else an intended user and does not create a service relationship with ProPraisal. ProPraisal assumes no legal liability to any party other than the intended user, unless reliance was agreed to in advance and in writing.

Property Condition & Environmental Limitations

ProScan Reviews are developed through desktop analysis using market data and the property information available for review. Value conclusions assume typical market condition unless reliable information indicates otherwise. Because this is a desktop-based service focused on providing a preliminary value indication, it may not reflect factors we cannot verify—such as unseen damage, deferred maintenance, renovations, or environmental concerns—which could affect value. If condition or environmental concerns are a factor, consult a licensed appraiser and/or a qualified specialist.

Not a Formal Appraisal

The ProScan Review is an expert opinion of value and is NOT a formal appraisal. It is not intended to meet the requirements of any lending institution or government agency. Our analysts are experienced professionals who have completed thousands of residential valuations, but the ProScan Review should not be used where a formal appraisal is required.

Limitation of Liability

ProPraisal's ProScan Review is provided for the intended use stated at the time of order and should be read in its entirety. To the fullest extent permitted by law, ProPraisal's liability for any claim, loss, or damage arising from the use of this review is limited to the fee paid for the service. ProPraisal is not responsible for any indirect, incidental, special, or consequential damages related to the use of the report.

Refund Policy

If ProPraisal determines that we cannot provide a clear opinion of value for your property due to insufficient data, unique property characteristics, or other limiting factors, you will receive a full refund of the service fee. Part 3: ProConsult Terms & Disclosures

Purpose of the ProConsult Assessment

The purpose of the ProConsult Assessment is to provide an independent, professional opinion of a home's market value as of the effective date—typically the date the assessment is completed. This helps clients make informed decisions—especially when deciding whether pursuing a property tax appeal is worthwhile—and can also support valuation needs for homeowners, real estate agents, attorneys, accountants, tax planners, and anyone who wants a credible, objective understanding of a home's value.

Data Sources and Market Analysis

To prepare your ProConsult Assessment, we rely on multiple trusted sources of real estate information. These include public county and assessor records, local MLS data, third-party real estate databases, and ProPraisal's proprietary sources and market analytics. Guided by ProPraisal's founder—a retired residential real estate appraiser with over 27 years of valuation experience—we analyze recent closed sales, active listings, and pending sales, together with property details provided online by the client, to understand the market and develop a well-supported opinion of value as of the effective date. While we take care to use reliable information, we cannot guarantee the accuracy or completeness of public records or third-party data.

Intended Use

The ProConsult Assessment is prepared for the intended use stated at the time of order. Most commonly, it is used to help determine whether pursuing a property tax appeal is worthwhile. It may also be used for other non-lending purposes such as homeowner decision-making, pre-listing valuation support, estate and divorce planning, dispute resolution, and general market-value insights.

Intended User

The intended user of the ProConsult Assessment is the client who orders the service and is identified in the report. No other intended users are identified unless agreed to in writing by ProPraisal in advance.

Third-Party Reliance

No other person or entity may rely on the ProConsult Assessment for any purpose.
